A. IBM General Statement
Supreme Decree No. 009-2019-MINAM, approved by the Peruvian Ministries of Environment and of Transportation and Communications on 8 November 2019, is a new Decree on WEEE management that replaces the old WEEE Decree No. 001-2012-MINAM.
The main objective of the new Decree is to determine the responsibilities of those involved in the management of WEEE in order to maximize its efficiency, reduce the generation of WEEE at the source and promote its recovery and adequate final disposal.
The decree applies to any generator, producer, operator, distributor or marketer who, within the national territory, carry out activities related to the management of WEEE deriving from the products listed in Annex II
The product categories of Annex II are the following:
- Category 1: large household appliances
- Category 2: small household appliances
- Category 3: information and communications technology (ICT) equipment << This applies to IBM
- Category 4: consumer electronic devices
- Category5: lighting equipment
- Category 6: electric and electronic tools
- Category 7: toys or sports and leisure equipment
- Category 8: medical devices and clinical laboratory equipment
- Category 9: monitoring and control instruments
- Category 10: vending machines
- Category 11: photovoltaic panels
The producer has extended responsibility for the EEE throughout its life cycle, including the post-industrial and post-consumption phases.
The main obligations of producers include:
- a) Design, implement and manage WEEE management systems, individually or collectively, that ensure proper management and handling of such waste.
- b) Submit a Plan for the Management of Waste Electrical and Electronic Equipment (Plan for the Management of WEEE) to MINAM, as appropriate.
- c) Comply with the commitments assumed in the approved Management Plan regarding the management and management of WEEE, including individual and collective collection goals as appropriate.
- d) Receive free of charge, within the national territory, the WEEE of its clients or those that have been collected by distributors and marketers that participate in the value chain of the EEE placed on the market; notwithstanding that they voluntarily receive, free of charge, WEEE from other generators.
- e) Directly inform their customers, distributors and marketers about the appropriate form of management and handling of WEEE, in accordance with the guidelines established in article 4 of this standard, emphasizing at the time of sale on:

- e.1. The separation of WEEE generated from municipal solid waste.
- e.2. The places and ways to deliver EEE at the end of its useful life.
- e.3. The delivery of WEEE is in your management system, at no cost.
- f) Publish in its electronic portal the information indicated in literal e on the handling and management of WEEE.
- g) Deliver the WEEE, through an individual or collective system, to an authorized WEEE operator, as well as inform the WEEE operator about the parts or components that contain dangerous substances or material.
- h) Comply with the procedure established by MINAM for the export of WEEE or its components.
- i) Report the producer's annual declaration, in accordance with the provisions of article 11. In the case of collective systems, the producer's annual declaration is submitted by the representative of the collective system.
- j) Submit the update of the WEEE Management Plan, as appropriate, in accordance with the provisions of Article 19 of this regulation, for its evaluation.
B. Environmental Notices and User's Guide
IBM products come with Environmental Notices and User's Guide that include information with the purpose of communicating specific environmental instructions to customers.
This is the symbol marked routinely on EEE products, which instructs customers to never dispose of WEEE in normal waste containers.
C. WEEE Collection and Recycling Services for IBM Customers
To comply with Supreme Decree No. 009-2019-MINAM, IBM has established a collection network by cooperating with Geodis (global logistics provider of IBM) and its local partners ITSANET Perú S.A.C., OCASA (Internacional Latinoamericana de Servicios S.A.) and the electronics recycling company COIPSA (Compañía Química Industrial del Pacifico) for collection and processing of all the unwanted electrical and electronic equipment of IBM brand.
IBM customers who own IBM branded products and do not want to keep them any longer can contact COIPSA directly for collection, recovery, rehabilitation (wherever technically possible), or proper recycling and disposal. IBM will accept any WEEE with the IBM logo that has previously been sold.

D. IBM Asset Recovery Services (ARS)
IBM business customers who have used IT equipment that is not considered a waste (not WEEE) but is suitable for asset recovery, restoration and resale can also use the IBM Asset Recovery Services (ARS) thru IBM financing Services.

F. Important message regarding Data Security:
Before sending any personal IT equipment for collection, retrieval and recycling, through any of the available carriers (Itsanet, Ocasa, Coipsa or IBM Asset Recovery Services), and regardless of the brand, you must remove all personal or confidential information that may reside on the equipment. IBM and its service providers (Itsanet, Ocasa and Coipsa) are not responsible for deleting or removing any confidential information on the WEEE. Consider using available software for erasing data on your computer’s hard drive before using any of the optional systems described above. Alternatively, you can also remove the hard drive from your computer(s) before sending it to any of these systems.
