2012 OFFICIAL RULES

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. Open to students age 13 and older who are legal residents of one of the fifty States of the United States, the District of Columbia or CANADA (EXCLUDING QUEBEC). Do not enter if you are not located in the 50 United States, DC or Canada (excluding Quebec) at the time of entry.


Registration

To qualify to participate in the IBM Master the Mainframe: An Enterprise Systems Contest (the "Contest"), you must first complete the on-line registration form, available at http://www.ibm.com/university/contest (the "Contest Site"). If you are a minor in your jurisdiction of residence, you will be instructed to print out a release, have it signed by your parent/legal guardian and have it submitted to Sponsor as per the online instructions. Registration is open from September 4, at 3:00 PM Pacific Standard Time ("PST") until December 20, 2012 at 11:59 PM PST (the "Registration Period"). Follow all instructions and complete the on-line registration form in its entirety. This registration process does not constitute official entry, but rather registration as a potential entrant.


Submitting your entry:

Once you have completed the on-line registration form, Sponsor will confirm your registration via email to the email address provided (within three business days) providing you with a mainframe user ID. You may use this mainframe user ID to log into each ""Part" of the Contest and submit each of your entries as set forth below. The Contest's submissions will be accepted during the period which begins on October 1, 2012 at 3:00 PM PST and ends on December 28, 2012 at 11:59 PM PST ("Submission Period").

  1. Part 1: You must enter and complete your submission to Part 1 of the Contest before you can participate in Parts 2 and/or 3. You may enter Part 1 by, during the Submission Period, visiting the Part 1 tab on the Contest Website and following the online instructions to complete the Part 1 challenges and submit them online. You will be given an opportunity to check your work over, but you may not make any further changes after you submit your Part 1 data set. Once submitted, Sponsor will judge your work for accuracy and notify you of your results via email within fifteen business days.
  2. Part 2: After you have completed, submitted and Sponsor has confirmed receipt of your Part 1 data sets, you may enter Part 2 by, during the Submission Period, visiting the Part 2 tab on the Contest Site and following the online instructions to complete and completing the Part 2 data sets and submit them online. You will be given an opportunity to check your work over, but you may not make any further changes after you submit your Part 2 data set. Once submitted, Sponsor will judge your work for accuracy and notify you of your results via email within fifteen business days.
  3. Part 3: After you have completed, submitted and IBM has confirmed receipt of your Parts 1 & 2 data sets, you may enter Part 3 by, during the Submission Period, visiting the Part 3 tab on the Contest Site and following the online instructions to complete and completing the Part 3 data sets. Contest judges (as described below) will log your account for Part 3 to verify the completion of Part 3 tasks; no formal submission of data sets needs to be made. Ties will be broken by the written report (as described below) submitted to zskills@us.ibm.com. Part 3 entries will be judged by a panel of qualified judges beginning on or about January 7, 2013. Sponsor's decisions are final and binding in all matters and disputes relating to this Contest, including, but not limited to, interpretation and application of these Official Rules. For greater certainty, such matters and disputes are to be resolved in IBM's sole discretion. By participating, you fully and unconditionally agree to be bound by these Rules and the decisions of the Sponsor/judges. Entrants will be judged in Part 3 on the number of points they earn by completing pre-defined tasks during the Submission Period. Each Part 3 task will be assigned a point value for successful completion. Judges will award partial credit for partial Part 3 task completion. The winner of Part 3 will be the contestant who accumulates the most points by completing Part 3 tasks. To interact with the mainframe in Part 3, contestants will have the option to download and install IBM Rational Developer for System z. Contestants may also continue interacting with the mainframe using the 3270 emulator that they used to complete Part 1 and Part 2. Whether a contestant chooses to interact with the mainframe using IBM Rational Developer for System z or the 3270 emulator will have no bearing on the outcome of Part 3. In the event of a tie, the winner will be the entrant having the highest score on a written report submitted to zskills@us.ibm.com. The report will be judged using the following criteria: (1) clarity of documentation - 1 to 10 points will be awarded; (2) technical understanding of completed tasks - 1 to 20 points will be awarded; (3) completeness of documentation - 1 to 10 points will be awarded (results subject to verification by Sponsor. Maximum amount of points available is 40. If there is still a tie, a new judge will re-judge the tied entries.

By submitting entries, you (or your parent/legal guardian if a minor on your behalf) grant IBM and its agents an irrevocable, nonexclusive and royalty free right and license to publish, use, adapt, display, transfer, reproduce, sell, edit and/or modify such entry (and electronic communications related to such entry and any information contained in such entry) in any way or form, in whole or in part, in commerce, in any and all media now known or hereafter invented, including without limitation, the internet, worldwide, in perpetuity, and without compensation to the entrants. By entering this Contest, you represent and warrant to IBM that each of your entries: (i) are your own original creation and are 100% original, (ii) are solely and exclusively owned by you; (iii) does not infringe on third party rights, (iv) has not won previous awards or has been posted on another Web site prior to submission and (v) is suitable for publication. Each of the foregoing shall be in Sponsor's sole discretion. Winners may be required to sign an additional affidavit/license (except where prohibited) to this effect. At Sponsor's discretion, you may be required to submit source code to substantiate results reported in the entry.

In the event of a dispute, entry is deemed submitted by the authorized account holder of the e-mail address used as the user name at the time of registration. Authorized account holder is defined as the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If your registration form is incomplete, you will not be eligible for the contest. Sponsor assumes no responsibility for computer system, hardware, software, network program, or other errors, failures, or malfunctions of any kind, whether human or technical in nature, in the transmission or receipt of entries or registrations.


Eligibility

Contest is only open to students age 13 and older who are enrolled full-time or part-time at an accredited educational institution (university undergraduate or graduate school, not including post-doctoral fellows); 2 or 4 year college; high school (students age 13 and older) in one of the 50 states of the United States, District of Columbia or Canada (except Quebec), which has at least one educator enrolled in the IBM Academic Initiative and are legal residents of one of the 50 states of the United States, the District of Columbia or Canada (except Quebec) ("Students"). Students may only submit one entry per Student for each part (Part 1, Part 2 & Part 3) of the Contest. Students who have not registered for the Contest during the Registration Period will not be eligible to submit an entry to any part of the Contest. Proof of enrollment in an academic institution (student ID and/or institution confirmation) may be required upon request of Sponsor. Employees of Sponsor and Ogilvy Action, and the immediate family members and household members of each are not eligible to enter the Contest. Void outside of the United States, District of Columbia and Canada (except Quebec) and where prohibited, taxed or restricted by law. You are only authorized to participate in this Contest if you are a resident in the United States, District of Columbia or Canada (except Quebec). All federal, state, provincial and local laws apply.

Prizes

  1. Part 1 Prizes (2,500): One Prize will be awarded to each of the first two-thousand, five-hundred students to submit 100% correct entries in Part 1 of the contest. The prize is a T-shirt. Approximate Retail Value: $15.00 USD. Total ARV: $37,500.00.
  2. Part 2 Prizes (60): One Prize will be awarded to each of the first 60 students to submit 100% correct entries in Part 2 of the contest. The prize awarded to each Part 2 winner will consist of a prize package, which includes the following:
  3. Part 3 Prizes (5): One prize will be awarded to each of the top five Students (as determined by the criteria in rule #3). The prize is a 32GB ASUS Transformer Pad Infinity TF700 with Wi-Fi, model TF700T-B1-GR, Approximate Retail Value: $499 USD. Total ARV: $2,495.00. The three highest scoring Students who are awarded Part 3 Prizes shall also receive a two (2) day trip for such winners to the IBM mainframe plant in Poughkeepsie,NY, including round trip coach airfare from commercial airport closest to winner's school, ground transportation to/from airports and between hotel and plant, and two nights standard accommodation at the Poughkeepsie Courtyard by Marriott. Trip must be taken on March 27-29, 2013 or that portion of prize will be forfeited. Approximate Retail Value: $1,500 USD. Total ARV: $4,500.

Approximate total retail value of all prizes: $50,615.00 USD. Value of trip prizes may vary with airfare fluctuations and point of origin.

No cash redemptions or substitutions of prizes except by Sponsor in the event of unavailability of any prize or as necessary to meet export requirements, Sponsor reserves the right to substitute a prize of equal or greater value. Prizes will be delivered to confirmed winners. Winners of trips must pay all taxes and any incidental expenses associated with travel and any expenses not specified and are responsible for proper travel documentation (e.g. Passport if Canadian citizens) and ensuring no impediment to enter the U.S. In the event a minor wins the two-day trip, the minor must have a parent or legal guardian sign and return a release form, available on the IBM Academic Initiative Web site, prior to taking the trip. The parent or legal guardian will also be required to attend the trip at Sponsor's expense. By accepting prizes, winners (or their parent/legal guardian if minors) further agree to release IBM and its subsidiaries, affiliates and related companies and each of their respective officers, directors, employees and agents, including but not limited to OgilvyAction, (the "Contest Parties" )from any and all liability, loss or damage of any kind arising out of or in connection with winners' participation in this Contest, or with respect to awarding, receipt, possession, use and/or misuse of any prize, or to participation in the Contest or in prize-related activities. Except where prohibited, by accepting prize, winner or if a minor, his/her parent or legal guardian acting on his/her behalf, consents to the use by the Sponsor of his/her name, address (city and state or province), likeness, and biographical information for advertising and promotional purposes worldwide, without limitation and without additional compensation.


Notification:

Winners of Part 1 and of Part 2 will be notified via email (within fifteen business days of the time stamp on their data set submissions for Part 1 and Part 2, respectively). In the event that a Canadian resident is selected as a potential Part 1 or Part 2 winner, he/she will be required to correctly answer a mathematical skill-testing question in order to qualify for their prize. Part 3 winners (or their parent/legal guardian if a minor in winner's place of residency) will be notified by express mail and via e-mail on or about February 4, 2013 and will be required to sign and return an affidavit/declaration of eligibility and release of liability/publicity within 7 days of notification (except where prohibited). If any winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Official Rules and requirements, such prize will be forfeited and may be awarded to an alternate winner on the basis of the criteria set forth herein. Upon prize forfeiture, no compensation will be given.


Conditions

Participation in Contest and acceptance of prize constitutes each winner's permission for Sponsor to use his/her name, address (city and state or province), likeness, photograph, picture, portrait, voice, biographical information, entry and/or any statements made by each winner regarding the Contest or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants and winners agree to release and hold harmless Sponsor, its subsidiaries, affiliates and related companies, partners and promotion and advertising agencies, including OgilvyAction, and each of their respective officers, directors, employees and agents (collectively, the "Contest Entities") from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. Entrants who do not comply with these Official Rules, or attempt to interfere with this Contest in any way shall be disqualified. Sponsor is not responsible if Contest cannot take place or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. You acknowledge that the Contest Parties have neither made, nor are in any manner responsible or liable for, any warranty, condition, representation or guarantee, expressed or implied in fact or in law, relative to prize or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose.


Additional Terms

Any attempted form of entry other than as set forth herein these Official Rules is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. The Contest Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Contest, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Contest or downloading any materials in this Contest. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Contest should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest or web site. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or IBM representatives.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of Liability; Disclaimer of Warranties

IN NO EVENT WILL THE CONTEST ENTITIES AND/OR THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE CONTEST. IN NO EVENT SHALL THE CONTEST ENTITIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $10. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES OR CONDITIONS SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.


Disputes; Governing Law

The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. For any controversy or claim arising out of or relating to these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Westchester in the State of New York. The parties agree not to raise the defense of forum non conveniens. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.


Use of Data

IBM will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the IBM's privacy policy for the United States at http://www.ibm.com/privacy/us/en/ and Canada at http://www.ibm.com/privacy/ca/en/. By participating in the Contest, entrants hereby agree to IBM's collection and usage of their personal information and acknowledge that they have read and accepted IBM's privacy policy.
