Official Rules


ELIGIBILITY: The IBM SportsHack Contest (“Contest”) is open only to individuals who have reached the legal age of contract majority in their state/country of legal residence at time of entry AND who are registered attendees at the IBM Impact 2014 conference (“Conference”) in Las Vegas, NV on April 29 and April 30, 2014. You must be present at the IBM Impact 2014 conference to participate. To participate in the Contest, you will need to use at least one (1) IBM technology (described below). Access to certain IBM technologies may require an IBM ID available through developerWorks. developerWorks is a web-based technical resource and professional network; there is no cost to become a developerWorks member. Employees, officers, directors of International Business Machines Corporation (“IBM” and “Sponsor”), BI WORLDWIDE (“Administrator”), their respective subsidiaries and affiliated companies, agents, contractors, advertising/promotion agencies, Contest judges, individuals engaged in the development, production, or distribution of materials for, or implementation of the Contest (collectively referred to herein as the “Contest Entities”), and the immediate family members (spouse, siblings, children and parents including foster and step-relations) or those living in their same household (whether or not related) as any person in any of the preceding categories are not eligible to enter or win a prize. THE CONTEST IS VOID IN AND TO RESIDENTS OF ALL CURRENT U.S. EMBARGOED COUNTRIES, AND WHEREVER RESTRICTED BY, WITHOUT LIMITATION, FILING OR REGISTRATION REQUIREMENTS, EXPORT CONTROLS, OR WHERE OTHERWISE PROHIBITED OR RESTRICTED BY LAW.

This Contest is open only to, and all entries must be received only from individuals, who must submit their entry by and on behalf of themselves. Businesses, corporations, institutions, enterprises, organizations, Government and Government owned entities (as defined herein) and any other similar or dissimilar entities are excluded from participation in the Contest, A Government Owned Entity (“GOE”) is defined as an organization/individual who meets any of the following criteria: Governmental bodies and employees - national, state, provincial, local, municipal government - and any department, agency, public enterprise or instrumentality of a government; State owned hospitals, schools, utilities; State owned enterprises (whether wholly or partly owned); Public international organizations; Private companies controlled fully or partly by or under common control with any of the above; a political party or party official, or any candidate for political office. GOE also includes GOE customers who may consist of: public schools, utilities and organizations licensed to provide public services; public international organizations, such as the United Nations or World Health Organization; entities subject to public procurement laws and regulations; other entities, even those that are privately held and those that are publicly traded, if a government, a public international organization, an entity subject to public procurement laws or a government official, owns or has the ability to exercise control over such entity; and U.S. Federal Clients, including: (i) executive, legislative and judicial branches of the U.S. Federal government, (ii) U.S. Government-affiliated corporations (e.g., Tennessee Valley Authority), (iii) quasi-governmental organizations (e.g., The Smithsonian Institution), (iv) commercial business enterprises operating under a U.S. Federal government power of attorney, or with Management Operating Contractor (MOC) status.

IMPORTANT NOTICE: Entrants have the responsibility to review and understand their employer’s policies, applicable laws, rules and/or regulations, tax implications, government and any other limitations (collectively “policies”) regarding eligibility to participate in promotions and/or receive Prizes in connection therewith. Furthermore, if an entrant participates without obtaining the appropriate approvals, or if an individual is participating in violation of any such policies, Sponsor may, in its sole discretion, disqualify the entrant and forfeit their Prize, if applicable. Contest Entities disclaim all responsibility and liability relating to the above; by entering Entrants agree to release, indemnify, defend and hold them harmless in all respects thereto.

PROMOTION PERIOD: The Contest begins on or about 6:00 AM Pacific Time (PT) on April 14, 2014 and ends on or about 2:00 PM PT on April 29, 2014 (“Promotion Period”). The clock on the Sponsor’s server shall be the official time keeping device for this Contest. All time referenced in connection with the Contest is Pacific Time. Entrants are solely responsible for determining the corresponding time zone in their respective jurisdictions; Contest Entities disclaim all liability or responsibility relating thereto.

HOW TO ENTER: There is a simple three-step process to follow during the Promotion Period in order to submit the initial part of your entry into the Contest; entries are not complete until the presentation at the event (as described herein) has been completed (“entry”).

1) Visit www.ibm.com/developerworks/mobile/sportshack/ (“Website”) during the Promotion Period and follow the online directions to register for the Contest and agree to these Official Rules.

2) Upon successful registration, you will have the opportunity to write and submit applications that generate, consume or analyze data related to fitness activity devices. The app must use fitness activity related data, or else will be disqualified. The goal when writing the code is to demonstrate your development skills to make the best use of data being generated to deliver innovative services to Mobile and Web users. When developing your app(s), you must use at least one (1) of the following IBM technologies:

Submissions that do not use at least one (1) of the above mentioned IBM technologies will be disqualified. Additionally, you may also use IBM open source tools Node-RED and MQTT, or other non-IBM technologies. Information on how to access and use the IBM technologies can be found on the Website.

There are two (2) categories (“Categories”) into which you can submit your code:

Limit one (1) entry per Category per person. Entrants may submit an entry for both Categories, but each entry must be eligible, entirely unique and different, and contain no redundancies (in Sponsor’s determination).

3) Upload the completed code for your app(s) to either JazzHub (hub.jazz.net) or GitHub (github.com) on the Website registration page. Then send an email to "blawrie@us.ibm.com" with your name, the address/link of your code, and the Category for which you are submitting your app. If you are submitting an app for each Category, you must send a separate email for each app submitted. All emails must be received by 2:00 PM PT on April 29, 2014.

You must complete all three steps in order to submit the initial part of your entry into the Contest (“entry”).

Without limitation, invalid, non-compliant, incomplete, incoherent, inadequate or inaccurate entries will not be eligible. Further, by entering this Contest, entrants hereby represent, warrant and covenant (as applicable), and agree to produce written evidence of such if requested, that:

(i) The entry, in whole and in part, does not violate or infringe upon any proprietary or intellectual property rights, including copyrights, trademarks, patents, trade secrets, industrial property rights, personal or moral rights, or any other rights whatsoever of any person and/or entity;

(ii) The entry submitted to the Contest is the sole and original work of the entrant created specifically for this Contest;

(iii) Entrant has all other rights, licenses, permissions and consents necessary to submit the entry and to grant all of the rights granted to the Contest Entities in these Official Rules (and in any written Agreement signed by entrant), and the exercise thereof by the Contest Entities and/or the use by them of the rights granted by entrant, in whole or in part, does not and will not give rise to any alleged or actual claims, disputes, actions or liabilities, including but not limited to those for disputes or payment of any kind, including without limitation royalties, residuals, attribution, credit, dues, consultation, work for hire, or any other fees, costs, or expenses;

(iv) The entry in whole or in part contains no malware, including viruses, trojans, worms, spyware or any other harmful software, code or other devices; and

(v) The entry in whole or in part contains no pornographic, sexually explicit (including nudity), defamatory, offensive, violent, discriminatory, cruel, abusive, highly sensitive, or illegal content, and/or technology or other content that is prohibited from export, content of an obscene or menacing character, and does not otherwise offend against reasonable standards of taste and decency.

In order to be eligible for this Contest, the entry, in whole and in part (and its entrant) must comply with all other terms stated in the Official Rules. By submitting an entry, entrants agree the Contest Entities are not responsible for, and shall be indemnified, defended, released and held harmless for/from any claims, actions or disputes between an entrant and any other entrant and/or third party relating to the entry, in whole or in part.

Entrants understand, recognize and accept that, without fault of the Contest Entities, other persons may have provided one or more of the Contest Entities, or others, or made public, or may in the future submit, or make public, materials that are the same or similar to entrant’s entry. In the event that an entry is identical or similar to the entry of another entrant, the Contest Entities reserve the right to award a prize to one entry that receives a higher judging score than the other, subject to the judging criteria set forth herein.

By submitting an entry, entrant’s agree to be bound by these Official Rules (available on the Website), and all Contest related communications from the Sponsor, and the decisions of the Sponsor and Judges, which are final and binding in all respects. Without limiting the foregoing, Sponsor has the right to verify entrants’ eligibility and compliance with these Official Rules and, on the basis of its investigation, to disqualify any entrant at any time during or after the Promotion Period. Contest Entities assume no responsibility for lost, late, incomplete, inaccurate, delayed, destroyed, damaged, or misdirected entries (in whole or in part), reports, data, or misreporting and/or non-compliance.

Without limitation, Sponsor reserves the right to immediately disqualify and/or remove at any time (before, during or after the Contest) any entry and/or entrant for any reason in its absolute discretion. Without limiting the foregoing, if at any time an entrant and/or winner is found to have breached, violated or failed to comply with these Official Rules (or any subsequent agreement), in whole or in part, at any time, or is or found at any time to be or have been ineligible, they will be immediately disqualified and agree to immediate return in full any and all Prizes to Sponsor (if applicable). For purposes of the Contest and pursuant to these Official Rules, unless otherwise specified, all materials and information submitted by an eligible entrant, in any and all media and medium, at any stage of the Contest will collectively constitute the “entry” or “submission”. Once submitted an entry may not be cancelled or deleted, and will not be returned. The entry as a whole will be considered and judged, but may be posted, viewed and used by the Contest Entities in whole or in part, as provided herein and by others interested in, involved with, or administering the Contest. Entrants assume all risk of ineligible, damaged, lost, late, incomplete, invalid, incorrect, incompatible, non-functioning, or misdirected entries, in whole or in part. Proof that an entry is uploaded at any stage does not constitute proof or evidence that it was received or eligible for the Contest.

ENTRANT PRESENTATION, JUDGING CRITERIA, AND WINNER SELECTION: Eligible entries received by Sponsor will be judged by a panel of subject matter experts in the fields of software development and/or technology innovation selected by the Sponsor. Entrants will be required to be present in order to participate further in the Contest. All travel, lodging and related costs and expenses are the sole responsibility of entrants. Judging will take place at a designated location at the IBM Impact 2014 event. The designated judging area will be posted on signage and printed materials at the Conference, and will also be posted on the Website.

All entrants must be present at the designated judging area by 4 PM PT on April 29, 2014. Between 4 PM PT and approximately 5:30 PM PT (which may be reduced or extended in Sponsor’s discretion due to exigencies of the situation), each eligible entrant will be randomly called before the panel of judges. Prior to being allowed to present and prior to being called, each entrant will be required to complete, sign, and return an Affidavit of Eligibility, Liability and, where lawful, Publicity Release (collectively “Affidavit”); failure to do so will result in disqualification. When called to present, entrant will have up to ten (10) minutes to personally “pitch” their app to the judges (“presentation”). Presentations and content therein collectively becomes part of the entrant’s entry. Entrants are permitted to use additional materials and devices during the presentation which help demonstrate the app they have developed, but the presentation must be completed within ten (10) minutes. Failure of an entrant to report for the presentation within five (5) minutes of being called may result in disqualification. All decisions and determinations relating to the presentations, times/dates, and location will be made by Sponsor and Judges in their absolute discretion. If at any time an entrant engage(s) in behavior that (as determined by Sponsor in its sole and absolute discretion) is unsportsmanlike, aggressive, cheating, fraudulent, obnoxious, dangerous, threatening, illegal, disorderly, or that is intended to annoy, abuse, intimidate, threaten or harass any other person, or may cause property damage or loss, Sponsor reserves the right to immediately terminate their participation, presentation, or other applicable experience early, in whole or in part, and disqualify entrant.

Data Insights Category: Each entry submission and presentation will be judged on the following criteria:

In the case of a tie, the tie will be broken (among the tied entries) by the highest score in the “Intuitive Interface” criteria for the Mobile App category, and the “Insights from Data” criteria in the Data Insights category. If a tie still remains for either category, the tie will be broken by the entry with the highest score in the “Potential Value to Users” criteria. If any entrant selected as a potential prize recipient for a given prize is disqualified for any reason, the next highest-scoring entrant, as applicable, will be designated as the potential recipient of that respective prize.

POTENTIAL WINNERS WILL BE ANNOUNCED DURING THE EVENT RECEPTION (between 4:00 PM PT and 5:30 PM PT) on April 30, 2014, AND MUST BE PRESENT IN ORDER TO CLAIM AND WIN THE RESPECTIVE PRIZE, or else prize will be forfeited and awarded to an alternate eligible winner based on score for the respective Category. If any potential winner fails to identify themself once announced at the event, is non-compliant, or found to be ineligible, he/she will forfeit the prize and an alternate potential winner may be selected in Sponsor’s sole discretion. Once notified via public announcement, potential winner will not be notified again. Sponsor shall have no liability for any winner notification that is intercepted, unheard, ignored, not received, not timely acted upon, incorrectly responded to, or otherwise not responded to for any reason by any potential winner. These Official Rules shall control and serve to clarify any confusion, discrepancy, error or mistake communicated in any and all notifications.

PRIZES:

Prize(s) may be received at the event and or shipped (depending on prize in Sponsor’s sole discretion) approximately six – eight weeks after the Event. Prize winners may be required to complete and return a Form W-9 prior to being awarded a prize. If applicable, winners are solely responsible for any local, provincial, state, federal/country or any other applicable taxes, compliance with (governmental) reporting, filing and documentation requirements, and for any other costs, expenses and fees connected with their acceptance and use of the Prize in their respective jurisdictions. Prizes will be awarded to and in the name of the individual. Winners are advised to seek independent counsel regarding tax implications of their prize winning. Prizes cannot be assigned, transferred, or substituted in whole or in part, except by Sponsor who may, at its sole discretion, substitute a prize of equal or greater value. Prizes are not redeemable for cash; any difference between the actual value and ARV of the prize will not be awarded as cash, or otherwise. Actual make, model, features, and equipment of a Prize are selected by Sponsor in its sole discretion.

Prizes, and any element thereof, including any products received as a prize, may not be sold, resold, auctioned, bartered, or placed into any other unauthorized channels of distribution. Any prize pictured or mentioned in advertising or Contest materials (including the Website) is for illustrative purposes only and may not be the actual prize awarded. With the exception of all valid Manufacturer’s warranties with respect to a prize, prizes are provided "AS IS” without warranty of any kind, either express or implied, including but not limited to, the implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement. Prizes and related logos, trademarks and/or registered trademarks are the property of their respective owners; which are not sponsors of, nor otherwise affiliated with this Contest.

LIMITATIONS OF LIABILITY: To the maximum extent permitted by law, entrants and winners agree to release, indemnify, defend and hold harmless (“release”) Sponsor, BI WORLDWIDE, all other Promotion Entities, their parents, affiliates, subsidiaries and divisions, and their respective entities, and each of their predecessors, divisions, directors, owners, officers, employees, members, managers, shareholders, successors, assigns, contractors, agents, insurers, guarantors, and representatives (“Released Parties”) from and against any and all threatened or actual claims, debts, demands, actions, causes of action, suits, proceedings, judgments, settlements (whether or not litigation is commenced), obligations, damages (including without limitation wrongful death, bodily or personal injury and disability), losses, accounts, reckonings, executions, liabilities, costs and expenses (including reasonable attorney’s fees), property damages and any other losses, penalties or fines whatsoever of any kind or nature, whether at law or in equity, known or unknown, asserted or un-asserted, that entrant ever had, now have, or that may arise in the future (“Disputes”) asserted in, arising out of or based upon participation in the Contest, the entry (in whole or in part), any Contest and/or Prize-related activity or inability to participate in or parts thereof, the delivery, acceptance, use, mis-use of a Prize or any failure with respect thereto, personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, any act, default, omission, non-compliance, and/or a violation or breach of any agreement, representation, warranty or covenant made herein, or any other agreements by/with Participant, the Promotion Entities, and/or any other party or entity. Further, to the maximum extent permitted by law, and without limiting the foregoing, Entrants and winners agrees to release the Released Parties from and against any and all threatened or actual Disputes arising at any time directly or indirectly brought by any persons or entities (who may be other than a party to these Official Rules) arising from or related to an entry, participation and/or involvement in any other respect with the Contest, and/or the delivery, acceptance, use, mis-use of a Prize or any failure with respect thereto. To the fullest extent permitted by law, entrants and winners covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind this release. A waiver by one or more of the Promotion Entities of any term in these Official Rules does not constitute a waiver of any other provision.

In no event will the Released Parties be responsible or liable for any indirect, incidental, consequential or punitive damages arising out of this Contest, participation in Contest and/or prize related activities, the use of the entry in whole or in part, the use or misuse of a prize or any element thereof, or access to, and use of any participating Website(s) or the downloading from and/or printing material downloaded from said site(s). Without limiting the foregoing, everything on the Website is provided "AS IS” without warranty of any kind, either express or implied, including but not limited to, the implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the Terms and Conditions of the Website, as a condition of entry and/or accepting a prize, entrants/winners grant to Sponsor (its affiliates, agents, successors and assigns and their authorized representatives) a non-exclusive, royalty free, worldwide right to use, copy, display, exhibit, publish, perform and distribute the entry in whole or in part, as well as to prepare derivative works in print, electronic (including the IBM web site) or any and all other media now known or hereinafter devised without additional compensation, and without right of review, notification or approval.

By entering and/or accepting a prize, entrants and winners hereby irrevocably consent, where lawful, to the use (but without obligation) by Sponsor (and their affiliated companies and their respective authorized representatives) of their name, company name, the name of the app, contest entry information, image, photographs, videotape, likeness, hometown name, biographical information, voice as well as any statements made by winner regarding the Contest or Sponsor (provided they are true) for publicity, trade, advertising and promotional purposes in all media now known or hereafter developed worldwide, including but not limited to the Internet, mobile devices, and World Wide Web, without additional compensation, and without the right of review, notification or approval.

In the event of noncompliance, if an entrant is or becomes noncompliant or ineligible during or after the Promotion Period, or a potential winner fails to respond within the time specified, or cannot be reached using the contact information (in Sponsor’s discretion) provided on the entry, that prize will be forfeited in its entirety and an alternate potential winner will be selected. Prize or prize notifications that are unclaimed, returned, undeliverable, or otherwise, will be forfeited and will not be awarded or re-awarded. Unclaimed or un-awarded prizes will NOT be re-awarded.

GENERAL CONDITIONS: Neither Sponsor nor its agencies are responsible for lost, late, misdirected, incomplete, unintelligible, illegible, stolen, returned, or undelivered entries or e-mail, or for lost, interrupted or unavailable satellite, network, server, devices, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, incompatibility, or errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information, nor for the failure to capture any such information. Persons who are suspected of cheating, tampering with, or abusing any aspect of the Contest or Website, as solely determined by the Sponsor, will be disqualified. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor is not responsible for injury or damage to entrants' or to any other person's computer or mobile device related to or resulting from participating in this Contest or downloading or uploading materials from or use of the Website. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes (similar or dissimilar) which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, or any element thereof and determine participants and/or winners from eligible entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction to, or unauthorized use of the Website. In the event of any discrepancy, ambiguity, inconsistency, printing or any other error or miscommunication in any advertising, brochures, Contest materials, announcements and/or any other information or communications in any and all media relating to this Contest or any element thereof, these Official Rules shall govern.

Contest Entities shall not be liable to entrants, winners or any other person or entity for failure to execute the Contest, or any element thereof or supply a prize, or any part thereof, by reason of any act of God, any action(s), regulation(s) order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist act, cyber-attack, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any similar or dissimilar event beyond their reasonable control.

DISPUTES: Governing Law: Sponsor’s decisions are final and binding in all matters and disputes relating to this Contest, including, but not limited to, interpretation and application of these Official Rules. For greater certainty, such matters and disputes are to be resolved in Sponsor’s sole discretion. The parties waive all rights to jury trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. For any controversy or claim arising out of or relating to these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Westchester in the State of New York. The parties agree not to raise the defense of forum non conveniens. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.

PRIVACY AND PUBLICITY: Entrants agree that personal data entered during the registration may be processed, stored, and otherwise used for the purposes and within the context of the Contest and as permitted by and in accordance with the Sponsor’s Privacy Policy found at http://www.ibm.com/privacy/us/en/. This data will be collected and maintained within the United States. By entering, entrants expressly agree to the transmission, processing, and storage of this personal data in the United States. By accepting a prize, entrant agrees and consents to Promotion Entities (and their authorized representatives’) use of entrant’s name, business name, image and/or likeness, hometown/country, biographical information, statements about the Contest (provided they are truthful) in any and all media now known or hereinafter developed (including but not limited to the world wide web, wireless and digital platforms, and the Internet) for promotional, marketing and advertising purposes without approval or compensation, to the fullest extent permitted by law. Entrants also understand this data may be used by Sponsor to verify an entrant’s identity and eligibility to receive a prize. Entrants have the right to access, review, rectify or cancel any personal data held by Sponsor in connection with the Contest by writing to Sponsor at the address listed herein.

WINNERS LIST: Winners will be posted on the Website on or about May 1, 2014.
